...has now been issued and it has some serious implications for
NHS Trusts, lift installation, servicing and maintenance contractors
and also engineering consultancies involved in the Built Environment,
who may now need to have proof (for insurance reasons), of their
engineers’ competency to undertake inspections and also in order
to tender for public sector/healthcare contracts.

Further information and answers to questions you may have
regarding HTM 08-02 and what it means for your organisation
from a Training perspective.


In response to calls and questions we’ve been receiving from our
NHS customers and Estates, Facilities Management & Engineering
clients, Eastwood Park has compiled this information to explain
about the new guidance & regulations, as they relate to Training,
including:

  • Roles and responsibilities: Authorised Person, Competent
    Person, Designated Person, Dutyholder, Lift Release
    Wardens
    & designated staff.  
  • Contractors’ responsibilities include: demonstration of their
    competence and awareness of changes to legislation; providing
    details of their training programmes and continuous professional
    development (CPD) arrangements relating to staff working on
    the contract which should also include competence to work on
    lifts installed by other lift companies. 

In brief...

  • You must now have a designated person (Lifts) who has
    overall authority and responsibility for lifts and their safe
    operation. This person must ensure an Authorising Engineer
    and Dutyholder are appointed.

  • An Authorised Person must be nominated by the Authorising
    Engineer (Lifts)
    and has the key operational responsibility
    for the specialist service.

  • The Authorised Person (Lifts) is responsible for overseeing
    the annual training exercises involving Lift Release Wardens
    and assisting the Authorising Engineer (Lifts) in ensuring
    sufficient personnel are trained and available at all times

    for the rescue of passengers who may become trapped in lifts.
  • A Competent Person (Lifts) is a person, suitably trained and
    qualified by knowledge and practical experience, and provided
    with the necessary instructions to enable the required work to
    be carried out safely.
  • Specialist contractors appointed by management should only
    use trained and competent persons to carry out the
    maintenance of lifts.
  • A lift Release Warden, is a person, suitably trained and
    qualified by knowledge and practical experience, and provided
    with the necessary instructions to enable the safe release of
    passengers from lifts. They should be recommended by the
    Authorised Person (Lifts), be formally appointed by
    management, and should undergo refresher training annually.

Management need to ensure that adequately trained staff are
available at all times to rescue passengers who may be trapped
in lifts
. Staff should receive appropriate training to act in such an
emergency. Sufficient numbers of staff should be trained in such
procedures so that at least two or more personnel are available on
the same shift to perform this function. Please see below* for further

relating to owners responsibilities for LIFT RESCUES & RELEASE
OF TRAPPED PASSENGERS and LIFT MAINTENANCE. 

  • Before appointment, a maintenance contractor should be
    able to demonstrate their competence and awareness of
    changes to legislation etc, and provide details of their
    training programmes
    and continuous professional
    development (CPD) arrangements relating to staff working
    on the contract. This should include competence to work
    on lifts installed by other lift companies. 
  • Training should be provided by an instructor, who has
    received instruction in training methods or can demonstrate
    a training competence following relevant experience.

The course should be structured to include:

  • formal classroom instruction
  • supporting notes and written procedures
  • demonstration of the procedure by the trainer
  • individual practice of the procedure and a written test 
  • Staff who successfully demonstrate competence in the rescue
    procedure should be given a certificate (valid for one year)
    recording the date of the training and the lift installations
    where they can carry out rescues.

*FIRE SAFETY REGULATIONS
… compliance in the workplace#

LIFT RESCUES & RELEASE OF TRAPPED PASSENGERS: Of all call-outs to Fire and Rescue Services across the country to release trapped passengers from lifts – only 5% of these are deemed ‘emergencies’.  Non-emergency callouts divert fire and rescue services from genuine emergencies.
 
LIFT MANAGEMENT:  Proper management of lifts within premises, is the responsibility of the building management or owner. The required risk assessment for the premises should include procedures for dealing with incidents involving persons stuck inside a defective lift … before calling the fire service.  In the event of a person being stuck within the lift due to a defect, full use of a competent person or lift maintenance contractor should be made to resolve the issue.

Do not call the fire service in the event that a person is stuck inside a defective lift – except in an emergency situation or if your in-house procedures fail.

Note: Fire services may CAUSE DAMAGE during a release. [A trained person] may be better skilled to release occupants of lifts with less damage.
